This page provides important information about using REDX products in accordance with laws such as the Telephone Consumer Protection Act (TCPA) and the CAN-SPAM Act.

Telecommunications Compliance

REDX makes available tools like the WAVV Power Dialer to help you efficiently connect with potential clients. However, it is critical to understand and adhere to legal regulations when using these tools.

What is an ATDS? An Automatic Telephone Dialing System (ATDS) is defined as a system that uses a random or sequential number generator or otherwise dials without human intervention in selecting and dialing each number.

The WAVV Power Dialer does not generate or store random or sequential numbers. It requires human intervention to select and dial each number.

Pre-recorded Message Compliance

  • All pre-recorded messages or voicemails require prior express written consent from the recipient.
  • Feature Note: WAVV Dialer allows you to disable pre-recorded messaging features unless compliance is certified by the customer.

 

Do Not Call (DNC) Compliance

  • REDX clearly marks numbers on the National DNC Registry, helping you identify restricted contacts.
  • You may only call DNC-listed numbers if:
    1. You have prior written consent on file.
    2. There is an Established Business Relationship (EBR):
      • 90 days from a consumer inquiry.
      • 18 months from a transaction or payment.

Database Compliance

REDX’s tools are designed to simplify client interactions, but it is your responsibility to:

  • Obtain and document consent before sending any communications.
  • Record and maintain opt-out requests for compliance with the CAN-SPAM Act. Opt-outs must be honored within 10 days and stored indefinitely unless reversed by the customer.
  • Track and document the start of EBR to comply with legal retention standards.

Compliance Feature: REDX’s personal DNC functionality can assist in tracking and managing compliance with DNC regulations.

When using REDX’s AdBuilder to create targeted campaigns, you must:

  • Include clear and visible consent language in lead generation ads.
